1. Welcome
These Terms of Service ("Terms") govern your access to and use of Businest, a service operated by Businest Inc. ("we", "us", "our") in partnership with EMY Africa. By using Businest, you agree to these Terms.
If you don't agree, please don't use the service. We've tried to keep these Terms readable. Where something is technical or legally important, we've called it out clearly.
2. Who can use Businest
You can use Businest if:
- You are at least 18 years old, or have permission from a parent or guardian.
- You can form a binding contract with us under the laws of your country.
- You are not barred from using the service under applicable law.
3. Your account
If you sign up for an account, you agree to provide accurate information and to keep it up to date. You're responsible for everything that happens under your account, so keep your password safe and let us know immediately if you suspect unauthorised access.
4. Listings and content
Businesses listed on Businest are independent third parties. We curate our directory and verify listings through EMY Africa's verification process, but we don't operate any of the listed businesses, and we're not responsible for the services they provide.
If you're a business listing on Businest:
- You must own or have authority to list the business.
- The information you provide must be accurate, lawful, and not misleading.
- You grant us a non-exclusive licence to display your listing content on Businest and promotional materials.
- You are responsible for honouring any commitments you make to buyers via Businest.
5. Acceptable use
Don't use Businest to:
- Post anything illegal, fraudulent, harassing, defamatory, or that infringes someone else's rights.
- Scrape, mass-download, or harvest data from the site without our written permission.
- Impersonate any person or entity, including another listed business.
- Interfere with the service or attempt to bypass security measures.
- Send unsolicited messages to listed businesses or buyers ("spam").
6. Reviews
If you write a review, it must be your own honest opinion based on a real experience with the listed business. We may remove reviews that violate these Terms or that we believe are fake, paid, or coercive.
Listed businesses may not retaliate against reviewers, offer incentives in exchange for positive reviews, or post reviews of themselves or competitors.
7. Verification badge
The "EMY Verified" badge indicates that a listing has completed our verification partner's review process. It is not a guarantee of service quality, financial stability, or legal compliance. We may revoke verification at any time.
8. Fees
Businest is free for buyers. Listing on Businest is free during our verification window. Beyond that, our pricing is described on our Pricing page. We never take commission on transactions between buyers and listed businesses.
9. Intellectual property
Businest's name, logo, design, and software are owned by Businest Inc. or our licensors. You may not copy, modify, or use them except as expressly permitted.
Content posted by listed businesses (logos, descriptions, images) belongs to those businesses or their licensors.
10. Disclaimers
Businest is provided "as is" and "as available". We don't guarantee that the service will be uninterrupted, error-free, or completely accurate. We don't endorse or guarantee the businesses listed on Businest, and we are not a party to any agreement between you and a listed business.
11. Limitation of liability
To the maximum extent permitted by law, Businest Inc. and its directors, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the service. Our total liability to you in any twelve-month period is limited to the fees you've paid us in that period (or USD 100 if you haven't paid us anything).
12. Termination
You can stop using Businest at any time. We may suspend or terminate your account if you breach these Terms, if we're required to do so by law, or if we discontinue the service. We'll give you reasonable notice unless we believe immediate action is necessary.
13. Changes to these Terms
We may update these Terms from time to time. If the changes are material, we'll let you know by email or by posting a notice on the site. Continued use after the changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Ghana. Any disputes will be resolved in the courts of Accra, Ghana, unless local law in your country requires otherwise.
